We collect nonpublic information from the following sources:

• Information that we receive from you on applications or other forms (such as your name and address).
• Information obtained during conversations with you, or observed during visits to your premises.
• Information gathered during the course of managing your property association or business.
• To collect customer information from the above-stated sources, MJLinx Properties may use the following means of communication to gather information: written, in-person, telephone, facsimile, electronically and online.

The information that we collect, as described above, is used for managing our services to you. We do not share information about our customers, or former customers, with non-affiliated third parties other than as permitted or required by law. For example MJLinx Properties may share all of the information listed above with non-affiliated third parties for, including but not limited to, the following reasons.

• Information that is necessary to protect the confidentiality or security of our clients' records.
• Information that is necessary to investigate and resolve client disputes or inquiries.
• Information that is required by individuals or entities who are assessing our legal compliance.
• Information that is required for MJLinx Properties to comply with the law.
• To an actuarial or research organization for the purpose of conducting actuarial or research studies.
• Information that is necessary to protect against or prevent fraud, unauthorized transactions, claims or other liability.

Examples of non-affiliated third parties with whom we are permitted or required by law to share information with are insurance carriers, insurance brokers, loss payees, additional insured’s and joint marketing partners.

We do not share client information with any affiliate. 

We restrict access to non-public information to outside service providers who need to know that information to provide products or services to you. We use a secure Internet and e-mail provider to protect the confidentiality of electronic communications. Appropriate action would be taken against any employee who impermissibly shares client information. We regularly review our security measures and employee education programs to help protect this information and when we share information with nonaffiliated third parties, we require that they have standards to keep this information private. 

MJLinx Properties utilizes the cloud property management software Propertyware for day-to-day operations. Personal and non-personal information gathered during your lease and the use of the Tenant Portal are stored in Propertyware database.  Propertyware is wholly owned by RealPage, a public traded company under the ticker symbol NASDAQ:RP. The company's privacy policy covers how information collected is shared and protected.  If you have further questions, directly contact Realpage Legal department at the address provided on their public website. 

The Site may include or provide links to other websites on the Internet that we do not control. Even if an affiliation exists between us and a third party website, each of these linked sites maintains its own independent privacy and data collection policies and procedures. While we expect our customers and affiliates to respect the privacy of our users, we cannot be responsible for the actions of third parties. We encourage you to consult that website’s privacy policy before providing Your Information to it and whenever interacting with any website. 

Our Services are not directed to children under 13 (or other age as required by local law), and we do not knowingly collect personal information from children. 

California law permits users that are residents of California to request the following information regarding our disclosure of your personal information to third parties for those third parties’ direct marketing purposes. We DO NOT disclose your information to third parties for marketing purpose.

The California Online Privacy Protection Act (“CalOPPA”) requires COMPANY to disclose how it responds to Do Not Track signals set in a User’s browser. We support Do No Track browser settings. If you enable Do Not Track privacy settings in the browser you are using, we will use commercially reasonable efforts to stop collecting the information that allows us to tailor the Sites to User preferences based on Users recent use of the Sites or services. Consequently, we will not store or use information about any other websites you visit, other than our Sites.

Any controversy or claim arising out of, or relating to, our privacy policy, or the breach thereof, shall be settled by arbitration in accordance with the rules of the American Arbitration Association, and judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. 

Under potential unforeseen circumstances, such as compliance with regulatory agencies or the sale or transfer of its interests, MJLinx Properties reserves the right to sell or transfer your information to a third-party entity that: 1) concentrates its business in a similar practice or service; 2) agrees to be MJLinx Properties' successor in interest with regard to the maintenance and protection of the information collected; and 3) agrees to the obligations of this privacy statement. 

MJLinx Properties reserves the right to amend this privacy statement at our sole discretion at any time. When we make changes to this privacy statement, we will post the updated content to our applicable website(s) and our services along with the effective date of the change. Your continued use of our services following the posting of changes constitutes your acceptance of such changes.
